Stretch Therapy Liability Waiver & Release of Claims
Assumption of Risk
I understand that assisted stretch therapy involves physical manipulation, pressure, and movement of my body. As with any physical activity, there is a possibility of muscle soreness, joint or soft-tissue soreness, or risk of injury, dizziness, or other unforeseen complications. I voluntarily choose to participate, accepting all inherent risks.
Health Disclosure
I confirm that:
I have consulted with a physician or have determined that stretch therapy is safe for me.
I have disclosed any relevant medical conditions, pregnancy, injuries, or any other limitations to Kia Monet Keller /The Aligned Exhale and will update them if my condition changes.
My role in ensuring my safety during the session is crucial. I will immediately inform my therapist of any pain, discomfort, or dizziness, as this will help in adjusting the session to my comfort level and safety.
Release of Liability
consideration of receiving stretch therapy from The Aligned Exhale, owner Kia Monet Keller, independent contractors, and employees:
I waive, release, and forever discharge the Released Parties from any claims, demands, causes of action, damages, or liabilities arising out of or connected to my participation, except for gross negligence or willful misconduct.
I assume full responsibility for any injury or loss that may occur while on the premises or under the care of the Released Parties.
Indemnification
I agree to indemnify and hold harmless the Released Parties against any claims brought by or on behalf of myself, my heirs, personal representatives, or assigns arising from my participation in stretch therapy.
Media Permission
I grant The Aligned Exhale and Kia Monet Keller permission to photograph or record my session(s) for marketing, education, or promotional purposes without compensation, with the assurance that participants' privacy and or anonymity is respected. Creating content is not something I do often or with every client. I ask people to model for actual content weeks in advance so that the client and I can make proper preparations for videography and photography.
Code of Conduct
Personal Boundaries: No one—client or therapist may touch the other without prior consent. Any form of inappropriate or sexual contact is strictly prohibited and will result in immediate termination of the session, and you will not be seen again for any services.
Attire: THIS APPLIES TO ALL GENDERS
Wear whatever makes you feel comfortable and confident, provided it is no more revealing than typical hot yoga apparel (e.g., shorts, sports bras, T-shirts, Leggings, or tank tops). This standard applies equally to all genders. Nudity, excessively revealing clothing, skirts/dresses, and see-through attire are not acceptable for services, as we want both you and your service provider to feel comfortable and secure during the session and uphold boundaries.
✅ DO wear:
• Comfy clothes you can stretch in, nothing that restricts range of motion (leggings, shorts, sweatpants, T-shirts)
• Grip socks or yoga shoes if you need something on your feet
🚫 DON’T wear:
• Skirts or dresses (hard to move and keep covered, or safe in poses)
• Crocs, sandals, flip-flops, sneakers DURING service
• Socks without grip because they can be slippery, which risks injuring you and your service providers.
Why?
We want you to be safe, comfy, and able to move without slipping or tripping, or accidentally injuring your service provider!
Professional Communication: Maintaining client confidentiality is a priority at A Space To Exhale. We ask that conversations remain professional, respectful, and relevant to the session. A Space will not tolerate offensive, rude, suggestive, or otherwise inappropriate remarks to maintain respect and professional boundaries, thereby avoiding any discomfort to staff.
Severability & Governing Law
If any portion of this waiver is found unenforceable, the remaining sections shall remain in effect. The laws of the State of Ohio shall govern this agreement. Venue for any dispute shall be in the courts of that state.
